In Idaho in 2005 Mike and Chantell Sackett purchased a lot on which to build a house. The EPA without any testing and using an extremely broad definition of “navigable waters” declared the lot a wetland. Further the Sacketts were given no right of appeal and were promptly assessed a fine of $75,000 a day for non compliance with the EPA’s instructions. The Sacketts hung tough.
