Quick-take for sidewalks and bike paths by government is no longer acceptable under the law in Ohio!

This story is really HUGE, but it has quit a few moving parts, so bear with me.

Bike paths and sidewalks are being built all across the United States so that someday, when we are forced to abandon are cars, we will have bike paths on which to travel. However, since bike paths are really expensive the feds have done two things to get local government to agree to build the bike paths. First the feds offer grants to the local government (the money is usually funneled down through regional boards), which in theory helps cover some of the cost of the road itself. In return the local government often has to promise to use a Complete Street design. A Complete Street design requires sidewalks and bike paths be built adjacent to the road that is being built or repaired.

It is not uncommon for these extra features, which really add to the overall width of the project, to force the taking (eminent domain) of private property on either side of the road bed.

To receive and keep the grant the local government has to adhere to a strict time-table. That means, if a property owner chooses to fight the loss of their property, the time-table may be slowed to the point that the grant may be lost. This explains why some local governments have used the “quick-take” process, which allows the local government to come onto contested property and get on with the project denying the property owner their day in court.

The logic has been that quick-take has been acceptable in the past to speedily facilitate the building of roads, but in recent years quick take is being used for sidewalks and bike paths, too.

What makes the Perrysburg, Ohio situation different is the homeowners who were threatened with eminent domain used the talents of Maurice Thompson Executive Director of the 1851 Center for Constitutional Law. Thompson was able to win this incredibly important court case which will prevent quick-taking property to build sidewalks or bike paths.  This will force the system to provide property owners their day in court and make it much more difficult for the Complete Street design to be used. New UN “Supreme Court” to judge U.S. for Climate Change Debt

The effort to create a Global Order is on a fast track, but it requires funding.  Climate Change is the cash cow that will provide the funding for the new Global Order. If Climate Change caused by man’s activities is accepted as a fact, then the developed countries (i.e. the United States and the European Union) can be blamed for the majority of the environmental abuses. Now, if there was only a body that could be made responsible for making the charges against the developed countries and passing sentences on the developing countries in the form of carbon taxes, the funding of a new World Order would be a piece of cake! United Nations’ PARIS CLIMATE DEAL FALLING APART UN ADMITS THERE WILL BE NO GLOBAL CARBON TAX

The newly formed United Nations Tribunal for Environmental Justice is designed to punish the developed nations (the U.S. and E.U.) for “environmental crimes”. The punishment meted out by the United Nations Tribunal is to be paid in the form of a Global Carbon Tax. But what if the many developing countries, who hope to suck the developing countries dry, cannot reach agreement on how to handle the Global Carbon Tax? Will their lack of unity, at the least, buy the United States time to get a new, hopefully better administration in Washington D.C. who will fight back against the loss of our sovereignty to the United Nations? Obama Administrations and U.N. Announce Global Police Force to Fight “Extremism” in the U.S.

Keep in mind that the Obama administration has gone out of their way to avoid calling Muslims extremists, but has not hesitated to call members of the Tea Party extremists. United States’ court places hold on clean water rule nationwide

As you know, the Federal Government, through the Water of the U.S. rule (an extension of the Clean Water Act of 1972) is trying to federalize, take control of, all the water in the United States. As you also know, a group of states led by North Dakota was successful in putting a halt to the effort (at least until further study is done). Bureau of Land Management set to close 600 miles of Colorado Roads

Closing roads is a very effective way to advance the Wildlands Project.

In Mesa Verde County in Colorado, the Bureau of Land Management (under direction of the Federal Executive Branch) is closing over 600 miles of public roads in spite of strong push back from citizens, local government, and the strong possibility that the agency is not following either state or federal law.

In this article, the agency, after some initial efforts to get the locals to go along, simply forces the local governments to submit; leaving the only recourse for the local government expensive time-consuming litigation, and the citizens without critical roads. This is an example of how, as the federal government grows, the Feds can reduce the effectiveness of local government preventing it from protecting its rural citizens from federal abuse.

One more comment, remember road closures prevent economic activity by those who wish to harvest the resources on and under the ground. Every time Bambi wins, economic activity of our natural resources, coal, oil, oil shale, natural gas, minerals, trees, etc. is stifled. Without strong economic activity, we cannot be a prosperous nation.
